By accessing or using Guyana Herbal (the "Platform," "we," "us"), you ("you," "User") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Platform.

You must be at least 18 years old to create an account. Users under 18 may browse only with parent or guardian supervision.

This Platform is for educational and informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

2.1 No Doctor-Patient Relationship

Using the Platform does not create a doctor-patient, herbalist-patient, or any other professional relationship between you and Guyana Herbal, Alpha Lab Technology, or any contributor.

2.2 Traditional Knowledge, Not Clinical Evidence

The information about Guyanese and Caribbean medicinal plants reflects traditional use, oral history, and community knowledge. Most traditional remedies have not been evaluated by the FDA, Guyana's Food and Drug Department, or any regulatory body. Statements have not been evaluated to diagnose, treat, cure, or prevent any disease.

Results, side effects, and safety vary by person. Information that is safe for one person may be dangerous for another based on age, weight, genetics, health conditions, medications, and other factors.

The Platform includes AI-powered features, including the Herbal Consultant chat, the Blend Builder, and the Plant Identifier (collectively, "AI Features"). You acknowledge and agree that:

• AI Features generate suggestions using large language models and may produce inaccurate, incomplete, hallucinated, or unsafe information.
• AI blends are generated combinations, not vetted formulas. They have not been reviewed by a licensed herbalist, pharmacist, or physician.
• The Plant Identifier is not a substitute for expert botanical identification. Never consume any plant identified only by an AI image-recognition tool.
• You will independently verify any AI output with a qualified professional before acting on it.
• We do not guarantee the availability, accuracy, or continued operation of AI Features.
• Conversations may be logged in anonymized form to improve safety and quality, as described in our Privacy Policy.

Guyana Herbal participates in affiliate programs, including the Amazon Associates Program. We may earn a commission when you click an affiliate link and make a purchase, at no extra cost to you.

• Affiliate links are marked or clearly labeled where displayed.
• We only recommend products we believe align with the Platform's educational purpose; we do not guarantee product quality, safety, or efficacy.
• Pricing, availability, and product details are controlled by the third-party retailer and may change without notice.
• This disclosure is provided in accordance with the U.S. Federal Trade Commission's 16 CFR Part 255 endorsement guidelines.

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate, current information and to update it as needed.
• One account per person. Do not impersonate any other person or entity.
• You may delete your account at any time from your Profile settings; deletion is permanent and removes associated journal entries, saved blends, and personal data, except where retention is required by law.

"User Content" means anything you submit to the Platform, including journal entries, plant suggestions, photos, reviews, community posts, and herbalist ratings.

6.1 Your License to Us

By submitting User Content, you grant Guyana Herbal a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, reproduce, and distribute the content for the purpose of operating and promoting the Platform. You retain ownership of your content.

6.2 Your Representations

• You own or have permission to share the content.
• The content does not infringe any third party's rights.
• The content is not medical advice and is not presented as professional guidance.

6.3 Prohibited Content & Conduct

You will not post or use the Platform to share:

• Diagnostic claims or prescriptions for any disease.
• Cures for cancer, HIV, COVID-19, or other serious illnesses.
• Unsafe dosages, dangerous preparation methods, or remedies aimed at children without professional context.
• Hate speech, harassment, sexual content, spam, or illegal content.
• Anything that violates intellectual property, privacy, or publicity rights.

We may remove content and suspend accounts at our sole discretion.

Where the Platform offers paid features (such as digital products, ebook downloads, or consultation bookings), the following applies:

• Payments are processed by third-party providers (e.g., Stripe). We do not store full card details.
• All prices are listed in USD unless otherwise noted; applicable taxes may be added at checkout.
• Digital products are non-refundable once delivered, except where required by law.
• Consultation bookings may be cancelled and refunded if requested at least 24 hours before the scheduled time; later cancellations are non-refundable.
• We are not a party to any consultation; herbalists listed on the Platform act as independent practitioners and you contract with them directly.

All Platform content not submitted by users — including text, design, code, logos, illustrations, and the Guyana Herbal brand — is owned by Alpha Lab Technology or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, redistribute, or create derivative works without our written permission, except for personal, non-commercial use.

The Platform may link to or integrate third-party services (Amazon, Google, WhatsApp, Stripe, payment providers, video hosts, etc.). We are not responsible for the content, policies, or practices of any third party. Your use of those services is governed by their own terms.

The Platform is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, error-free, or that any content is accurate, complete, current, reliable, or safe.

To the maximum extent permitted by law, in no event shall Alpha Lab Technology, Guyana Herbal, or our directors, employees, contributors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including personal injury, illness, death, lost profits, lost data, or harm of any kind — arising out of or related to your use of the Platform, even if advised of the possibility of such damages.

To the extent liability cannot be excluded, our total aggregate liability to you for all claims is limited to the greater of (a) USD $50, or (b) the amount you paid us in the 12 months preceding the claim.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless Alpha Lab Technology, Guyana Herbal, and our affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Platform, your User Content, or your violation of these Terms or any law.

We may suspend or terminate your access at any time, with or without notice, for any reason, including suspected violation of these Terms. Provisions that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall survive.

We may update these Terms at any time. Material changes will be indicated by updating the "Effective" date and, where appropriate, by notice in-app or by email. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of the Co-operative Republic of Guyana, without regard to conflict-of-laws principles. You agree that any dispute will be brought exclusively in the courts of Guyana, except where applicable consumer-protection law grants you the right to bring proceedings in your country of residence.
